Important Immigration Update
All natural persons fourteen (14) years of age or older and present in the United States, applying for a license with The City of Nowata are required, by the provisions of 56 O.S. Supp. 2007 § 71, to provide the city with verification of lawful presence in the United States by executing the Affidavit available via PDF below.
The Affidavit must be notarized. To receive free notary service, you must bring the affidavit in person and sign in the presence of a notary.

How to get a Business License in the City of Nowata:
All businesses that wish to operate in the City of Nowata, regardless of their function and their business headquarters or modality (i.e. at-home, an office, food truck, etc.), must at a minimum complete the following:
- Complete an initial general application for a City of Nowata Business License
- Complete a notarized Immigration Affidavit
- Provide their state and/or Federal ID number
- Provide a copy of their General Liability Insurance
- Pay an annual $40.00 license fee (fee may vary based on type of business operated)
- Renew their business license on an annual basis

General Description:
An Advertising Business is any person engaging in the business of advertising in buses, on taxicabs or any other motor vehicles for hire, any outdoor advertising, advertising sign painting and contracting, bill distributing or distributing other advertising matter, advertising by posting, sticking, tacking, affixing, printing bills or signs to or upon posts, fences, billboards, advertising signboards, drop curtains, buildings or any other structure used in whole or part for advertising purposes.

Alcohol Beverage License
General Description:
Any alcohol, spirits, beer, and wine and every liquid or solid, patented or not, containing alcohol, spirits, wine or beer and capable of being consumed as a beverage by human beings, but does not include low point beer.

Building Contractor (Residential Only)
General Description:
A building contractor is any person contracting to make or provide any beneficial or valuable change or addition, betterment, enhancement, or amelioration of upon or to any new, proposed or existing structure on private property for which a building permit is required. The person must register as a building contractor.

Day Care & Day Camp License
General Description:
A Day Care is any day nursery, nursery school, foster home, or preschool or any place, home or institution which receives eight or more children under the age of 18 years, and not of common parentage, for foster care apart from their natural parents, legal guardians or custodians.
A Day Camp is any camp with a primary emphasis on outdoor education and recreation which exercises custodial care over children five to 18 years of age, except for older handicapped participants and which operates only during periods specifically designated as vacation from the school in which the child is enrolled and which operates for no more than 12 hours per day or a day camp which is accredited by the American Camping Association or other national standard-setting agency or church camp accreditation programs.

Home Occupation License
General Description:
No person, firm, association, or corporation shall engage in a business permitted in a residence and qualified as a home occupation without first having obtained a license from the City Nowata and paid the associated fees for said license.

General Description:

Mobile Food Vendor License
General Description:
A Mobile Food Vendor is any food establishment operating from a vehicle, trailer, or cart that is either (1) designed and equipped to prepare, cook, and serve open food products or (2) that is limited to the sale of commercially manufactured pre-packaged products or products that are prepared and packaged at a licensed food service establishment, and does not stay in one (1) location longer than
seventy-two (72) hours.
While a non-permanent Mobile Food Vendor serving in one (1) location for a temporary period of time. Can be a truck, trailer, or cart. Stationary Food Vendors stay in one (1) location for longer than seventy-two (72) hours and must obtain a Temporary Use Permit (TUP) in addition to completing the Mobile Food Vendor application.

General Description:
An Outdoor Seller is any person offering or exposing for retail sale, or making retail sales of, any foodstuffs, beverage, goods, products, wares, or merchandise or other personal property of any type, at any fixed outdoor business location. This does not include merchants who regularly offer such items for retail sale within permanent structures located on the same premises.

General Description:
A Certificate of Compliance for Occupancy is a document provided by the City that proves a structure is habitable based on its legal use and type of property and meets all housing and building codes.

Certificate of Compliance (Alcohol)
General Description:
A Certificate of Compliance for Alcohol is required by the ABLE Commission as part of the ABLE application. The City of Nowata determines your compliance with City codes relating to zoning, fire, safety and health.

Certificate of Compliance (Medical Marijuana)
General Description:
A Medical Marijuana Certificate of Compliance (MMCC) is required by the Oklahoma Medical Marijuana Authority (OMMA) as part of the medical marijuana business license application for both new and renewal licenses. A medical marijuana business must comply with City codes relating to zoning, fire, waste, and specific building safety codes in order to receive a MMCC. Each type of OMMA license requires a separate MMCC application.
Step 1 of the Application

Step 2 of the Application
Payment & Review of Application
Payment is required at time of application. Plans and application will be reviewed for compliance of building codes, zoning and related ordinances. Fire, industrial waste, and construction inspectors will inspect the business location for compliance. The compliance approval process generally takes 2 - 3 weeks. Additional permits and inspections may be required before acceptance of your MMCC application.

Step 3 of the Application
Construction Permitting & "Status Check" Inspections
If construction work at your business requires a permit, a licensed contractor will be required to perform the work and to obtain the necessary permits from the City of Nowata. The licensed contractor will also contact us when the work has been completed to request the necessary inspections.
If you advise us that no construction work has been done at your business, we will need to perform "status check" inspections for each MMCC type at your location to verify that information. Please contact Nowata City Hall to request a "status check" inspection for grow facilities and processing facilities.

Please bring all required business documents, completed City of Nowata permitting and application documents, and the associated fees for your application to the Community Development team at Nowata City Hall during regular hours of operation.
